What happened was he was driving to work one day and on the way he was stopped at a red light. The light turned green he started to drive, but not very fast mind you, when he heard sirens from an emergency vehicle. He looked around to see where it was coming from, he couldn't see them so he looked forward again. The driver in front of him had stopped in the middle of the intersection. My dad stopped but he still hit her back end making the accident his fault even though it wasn't really.
Well then end result of this accident was my dad's car was totaled, mostly because it was old. My dad got a ticket, even though it was also the woman's fault too. And everyone walked away with minimal injuries, from what I understood. All in all it was a low speed accident (dad probably wasn't going more then 10 or 15 mph when he hit her) and most of the damage was too my dad's car. But I think the important thing to stress here was that everyone walked away from this accident. As in no injuries.
Well it's been a year now and our insurance company was unable to settle with this woman and her crappy insurance company that probably isn't worth the paper its policy is printed on.
Apparently what's going on is that this woman wanted something like $300,000 for "bodily injuries" that were "allegedly associated" with the accident. I overheard my dad say that our insurance company will provide for his defense and what not, which I guess it good... But still the fact remains that my dad is getting sued for an outrageous amount because of false facts.
I'll ask my dad for details later but currently what I've said is about all I know so far.
[EDIT:]
So I talked to my dad about whats going on exactly and the info I said before is correct but what I didn't know is that my dad hasn't been sued yet. There is a chance he might not be. But here's what happened:
So apparently the personal injury belongs to the woman's 2 year old who wasn't even in the accident, according to my dad. The child allegedly hurt his or her back in the accident even though he or she wasn't even in the car when it happened.
The insurance company refused to settled the claim outside of court because the damages claim (a.k.a $300,000) was way too outrageous for any injury that could have possibly been received in the accident. So now if the woman wants the money she's going to have to sue for my dad for it. Now the burden of proof will be on this woman and her attorney. But the injuries in question probably never existed in the first place and the insurance rep that dad spoke to said that "a jury of six people can tell that [these people] won't do anything good with that kind of money". The chances of this thing actually going to court are slim and if it does end up going to court then the odds are in my dad's favor.
And on top of it all, dad mentioned that this might all be a scam and if that's the case this woman might actually serve some jail time for it.
Wouldn't that be something, huh?
